Estos requisitos transforman las normas internacionales no vinculantes existentes en mandatos aplicables, que afectan incluso a las empresas implicadas indirectamente a trav\u00e9s de las cadenas de valor, lo que conlleva un aumento de las exigencias y obligaciones relacionadas con la sostenibilidad.<\/p>\n<p>La Directiva deja claro en su anexo que la seguridad privada ser\u00e1 objeto de especial escrutinio:<\/p>\n<ol>\n<li>\u00abEl abuso [del derecho a la vida] incluye [&#8230;] a los guardias de seguridad privada o p\u00fablica que protejan los recursos, las instalaciones o el personal de la empresa y causen la muerte de una persona por falta de instrucci\u00f3n o control por parte de la empresa\u00bb;<\/li>\n<li>\u00abLa prohibici\u00f3n de la tortura y de los tratos crueles, inhumanos o degradantes [&#8230;] incluye [&#8230;] a los guardias de seguridad privada o p\u00fablica que protegen los recursos, las instalaciones o el personal de la empresa que someten a una persona a tortura o a tratos crueles, inhumanos o degradantes debido a la falta de instrucci\u00f3n o control por parte de la empresa\u00bb.<\/li>\n<\/ol>\n<p>El anexo 6 de la Directiva establece las condiciones de trabajo que deben cumplir las empresas, incluidos salarios justos y adecuados, condiciones de vida decentes, condiciones de trabajo seguras y saludables y limitaciones razonables de las horas de trabajo. Estas disposiciones est\u00e1n en consonancia con los <a href=\"https:\/\/icoca.ch\/es\/working-conditions\/\">esfuerzos de ICoCA<\/a> por defender las normas \u00e9ticas y proteger los derechos de los trabajadores del sector de la seguridad privada.<\/p>\n<p>Como se indica en el #42, <em>\u00aben las zonas afectadas por conflictos y de alto riesgo, [&#8230;] es m\u00e1s probable que se produzcan abusos de los derechos humanos y que \u00e9stos sean graves. Las empresas deben tener esto en cuenta a la hora de integrar la diligencia debida en sus pol\u00edticas y sistemas de gesti\u00f3n de riesgos para garantizar que los c\u00f3digos de conducta y los procesos establecidos para llevar a cabo la diligencia debida se adapten a las zonas afectadas por conflictos y de alto riesgo, de forma coherente con el derecho internacional humanitario, tal y como se establece en los Convenios de Ginebra de 1949 y sus protocolos adicionales.\u00bb<\/em><\/p>\n<p>La CSDDD subraya la importancia de las iniciativas multipartitas para garantizar la aplicaci\u00f3n efectiva y el cumplimiento de sus requisitos. Dada la presencia de empresas de seguridad privada (ESP) en las cadenas de valor de todos los sectores a los que se dirige la Directiva y como la \u00fanica iniciativa multipartita con el mandato \u00fanico de llevar a cabo la diligencia debida en materia de derechos humanos en la seguridad privada, especialmente en las zonas afectadas por conflictos y de alto riesgo, ICoCA espera apoyar la aplicaci\u00f3n efectiva y el cumplimiento de la Directiva, as\u00ed como contribuir a su desarrollo y orientaci\u00f3n espec\u00edfica en los pr\u00f3ximos a\u00f1os.<\/p>\n<p>Mientras tanto, si su empresa contrata a ESP, la<a href=\"https:\/\/icoca.ch\/es\/procurement-guide\/\"> Gu\u00eda de Contrataci\u00f3n de ICoCA<\/a> ofrece una introducci\u00f3n a la diligencia debida en materia de derechos humanos en la contrataci\u00f3n con ESP.
